BACKGROUND
We at Agway Energy Services are licensed by the Pennsylvania Public Utility Commission to offer and supply natural gas services in
Pennsylvania. Our PUC License Number is A-125125. We set the commodity prices and charges that you pay. The Public Utility
Commission regulates distribution prices and services. You will be billed monthly by Agway Energy Services or your Utility for natural gas
delivered under this Agreement at the price agreed to herein. Right of Recision: You may cancel this agreement at any time before
midnight of the third business day after receiving this disclosure.

DEFINITIONS
Commodity Charges:
The charges for the natural gas produced which is sold in either cubic feet or dekatherms.
TERMS OF SERVICE
- Basic Service Price
Variable Rate Option:
Your initial price including all Pennsylvania state taxes, shall be
$12.99 per MCF
which can vary monthly to reflect market
conditions but will be no lower than $2.00/ mcf or higher than $50.00/mcf. Sales and use taxes will be separately charged.
Fixed Price Option:
You will
pay
$16.69 per mcf
for the commodity of natural gas. This price includes all Pennsylvania state taxes including gross receipts taxes, sales, and use taxes, if
any. The price may change after the second year of the agreement, but if such change occurs, you may renew or cancel the agreement.

Length of Agreement
You will buy your natural gas services for the above street address from Agway Energy Services beginning on a date set by your Natural
Gas Distribution Company and will continue for 2 years.

Special Terms & Conditions
- Security Deposit: Agway Energy Services may request a customer credit report and require the customer to provide a security
deposit before providing basic service. We may perform a credit check according to applicable regulations.
- Liability: No party will be liable for any direct, punitive, incidental, consequential, exemplary, indirect,
third-party claims are based on contract, warranty, tort, negligence, strict liability or otherwise, or for lost profits
arising from a breach of this agreement.
- Force Majeure: You and Agway Energy Services are relieved of your obligations under this agreement during a Force Majeure,
defined as an event or cause not reasonably within the control of a party and which by exercise of due diligence cannot be
prevented or overcome.
- Agency: Agway Energy Services is appointed agent for the purpose of acquiring natural gas supplies, contracting for and
administering transportation and other related services.
- Penalties, Fees and Exceptions
If you do not pay your bills on time we will charge you a late payment fee of 1.5% per month. We will charge you a returned
check fee of $20.
- Cancellation Provisions
If you do not pay your bills on time, we will cancel this agreement by providing you with
fifteen (15) days prior written notice. You may cancel this agreement by providing us with thirty (30) days prior
written notice.
- Agreement Expiration/Change in Terms
If you have a fixed term agreement with us that is longer that 3 months and it is approaching the expiration date or if we
propose to change our terms of service, we will send you written notice in the third and second bills for supply charges or in
separate mailings before either the expiration date or the effective date of the changes. We will explain your options in these
two advance notices. Agway Energy Services reserves the right to pass along increases in utility charges applied directly to Agway Energy Services (e.g. accounts
receivable billing charges, etc.), which are the result of Public Utility Commission Orders or actions. This agreement may be assigned to another energy services company.
- Dispute Procedures
Contact us with any questions concerning our terms of service. You may call the PUC if you are
not satisfied after discussing your terms with us.
